Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), updated in May 2018. Article 13, states that where personal data relating to a data subject are collected from the data subject, the controller shall, at the time when personal data are obtained, provide the data subject with all of the following information: the identity and the contact details of the controller and, where applicable, of the controller’s representative.

1. Terms of use

Field, object and scope

Current conditions (hereinafter, the «TERMS OF USE») regulate the access and use of the website service that EBRIS makes available to Internet Users (hereinafter, the «USER/S») through https://opade-project.eu/ domain (hereinafter, the «WEBSITE»).

Notwithstanding the foregoing, access to certain content and the use of some of the services that EBRIS makes available to the USER through the WEBSITE could be subject to certain specific conditions (hereinafter, the «SPECIAL CONDITIONS«) that, according to the case, will replace, complete and/or modify these TERMS OF USE and, in case of contradiction, will prevail over the previous ones. These SPECIAL CONDITIONS, if applicable, will be available to USERS on the WEBSITE itself.

Consequently, before accessing to the mentioned content and/or use the mentioned services, the USER must carefully read and, if applicable, accept the SPECIFIC CONDITIONS that regulate them in reference to the version published at the time the mentioned access and/or use.

EBRIS reserves the right to carry out, at any time and without prior notice need, any content modification or update of the current TERMS OF USE, as well as, if appropriate, of the corresponding SPECIFIC CONDITIONS and, in general, of all those elements that are part of the design and configuration of the WEBSITE.

The TERMS OF USE published in the last WEBSITE update will be the ones in force, being applicable in each visit those terms that are published at that moment on the WEBSITE.

Accessing the WEBSITE, the USER consents and accepts, expressly and without reservation, these TERMS OF USE according to which the use conditions are determined, including in the mentioned acceptance the validity and effectiveness of any written and signed contract. In the event that the USER does not fully accept these TERMS OF USE, they will not be authorized to access the WEBSITE.

Economic conditions of the WEBSITE access and use

Unless other indication in the SPECIFIC CONDITIONS, the access to the WEBSITE and its content will be free, except for the connection cost to the telecommunications network that the USER has contracted with his/her provider.

Intellectual Property Rights

All brands, trade names or distinctive signs (of any kind) included in the WEBSITE will be property of EBRIS or, if applicable, of the third parties who authorize their use. The use or access to the WEBSITE and/or its content will not give the USER the right of those brands, trade names and/or distinctive signs or implies the transfer of the exploitation rights that exist or may exist in relation to the mentioned content.

In the same way, all the content is part of EBRIS’ intellectual property or, if applicable, third parties. Consequently, intellectual property rights will belong to EBRIS or third parties, who may authorize their total or partial use in the exclusive exercise of the exploitation rights under any form, more specifically, of reproduction, distribution, public communication and transformation rights.

Any unauthorized use of the information part of this website, as well as any infringement of the Intellectual or Industrial Property rights of EBRIS or of third parties included in the WEBSITE will imply the responsibilities established by the corresponding law.

Responsibility and guarantees

The user who visits the WEBSITE assumes at his/her own the possible risks. Accessing the WEBSITE, the USER agrees (i) not to carry out any conduct that could damage the image, interests and rights of EBRIS or third parties; that could damage, disable or overload the WEBSITE or that could prevent, in any way, the normal use of the WEBSITE; and (ii) use the WEBSITE full way according to the Laws and traffic application.

Consequently, the USER will have to respond to EBRIS and/or to third parties for any damages that may have caused as a result of not respecting these obligations.

EBRIS does not guarantee the absence of interruptions or errors when visiting the WEBSITE or its content or its update. Nevertheless, it will make an effort to avoid, correct or update these elements in the corresponding way. Consequently, EBRIS does not accept any responsibility for any damages or losses caused to the user as a result of errors or disconnections in the telecommunications networks due to the suspension, cancellation or interruption of the WEBSITE service.

With the exception of the provisions included in the current legislation, EBRIS refuses any responsibility for any damage or loss that may occur due to the lack of availability, continuity or quality of the WEBPAGE operation and of the Contents or due to the not compliance of the users’ expectations about the WEBSITE and the content.

The purpose of the hyperlinks that appear on the WEBSITE is exclusively oriented to inform users about the existence of other websites containing information related to the subject. These hyperlinks do not constitute, in any case, a suggestion or recommendation.

EBRIS does not assume any responsibility related to the content of linked pages, the operation or utility of the hyperlinks or the results of these links, not guaranteeing the absence of viruses or other elements that may disrupt the computer’s system (hardware and software) and user’s documents or files and will refuse the responsibility for any damages related to the mentioned reasons caused to the user.

The WEBSITE access does not imply any obligation for EBRIS to control the absence of viruses or any other harmful IT element. The user is responsible, in all cases, for the availability of the appropriate tools to detect and disinfect harmful computer programs. EBRIS does not assume any responsibility for security errors that may occur while visiting the Page or for possible computer system’s damages of user’s or third parties (hardware and software) or stored files or documents due to the presence of viruses in the computer of the user who uses it to connect to the services and contents of the WEBSITE, a not proper operation of the browser or the use of an obsolete versions of the browser.

Linked sites

Through the WEBSITE, EBRIS makes available to the USER linkage technical devices (such as buttons, links and banners) that may lead the USER to other websites or Internet sites owner/or managed by third parties and over which EBRIS does not exercise any type of control (hereinafter, the «LINKED SITES»).

When using those linkage devices and visiting the LINKED SITES from the WEBSITE, the USER must have in mind that these TERMS OF USE will no longer be applicable.

EBRIS does not know or control the content and services included in these LINKED SITES. The inclusion of access to the linked sites through the WEBSITE does not imply, in any case, (i) EBRIS’ recommendation or approval of the content and services hosted on the LINKED SITES and/or (ii) the existence of any relationship, collaboration or dependency between EBRIS and the person in charge of the LINKED SITE.

Consequently, EBRIS does not assume any type of responsibility related to the LINKED SITES and, therefore, is not responsible for the operation, content and services hosted or the links contained in the mentioned LINKED SITES.

In case that the USER has effective knowledge of the illegality or inadequacy of the content, services or any other activities developed through a LINKED SITE, the user must immediately notify EBRIS about this fact which will allow EBRIS to adopt the corresponding measures.

Hyperlinks

Anyone who wants to create hyperlinks between the Website and the Page must observe and comply with the following conditions:

  • All third-party links to this page must be directed to the main page.
  • The establishment of hyperlinks that only allow access to the main page does not require prior authorization, not being possible to reproduce it. Any other hyperlink form requires the express and unequivocal written authorization of EBRIS.
  • It is not allowed to create structures with or on EBRIS’ web pages.
  • No false, imprecise or offensive statements will be made in reference to EBRIS, its directors, employees or partners, or the people mentioned on the Page due to any reason or by any user of the page or the content included.
  • It will not be indicated or implied that EBRIS has authorized the hyperlink or that it has supervised or assumed the content offered or made available on the website in which the hyperlink has been included.
  • The Web page where the hyperlink has been included will only contain the strictly necessary information to identify the objective of the hyperlink.

The Web page on which the hyperlink has been included will not contain illegal information or content contrary to morality and generally accepted good practices and public order, nor content contrary to the rights of third parties.

5. Applicable legislation and jurisdiction

The following TERMS OF USE are subject to the Italian and European legal system.

For the resolution of any conflict that may occur from accessing the WEBSITE, its content and/or the services that EBRIS makes available to the USER through the WEBSITE, the USER and EBRIS expressly agree to submit to the Courts and Tribunals of Salerno, deliberately renouncing any other jurisdiction that could be applicable.
